If you have a third party only policy no. If you have a comprehensive policy yes.
If you carry “collision insurance”, your company pays no matter who is at fault. It’s pretty much mandatory coverage if it’s a fresh car so the lender can protect it’s investment.
Does the insurance company have the right to total your car even if their insured was at fault for the accident?
Your car being deemed a total loss does not have anything to do with the liability of the accident. Your vehicle becomes totalled when the repair cost exceeds the local market value of your vehicle.
Do you have to let the insurance company total your car if you were not at fault?
Liability, or whether or not you are at fault, has nothing to do with your vehicle being deemed totalled. If the repair cost exceeds the local market value of your car, it is a total loss.
How do you appeal when the car insurance company finds you at fault and you are not?
Please give me more information, and I’m sure I can help. Facts of loss? Exactreason they denied your claim? They must give you the reason that your claim was denied, or that you were found neglient. You can file with your company then they can arbitrate the claim for a decision, you can contact the dept of insurance for your state. You can file suit (petite claims if under the limit), if you secure a judgment against their insured they will have to pay, (barring any appeals of course), but need to know the reason for denial, to be of real help to you.
How will an at-fault accident while driving a company car covered by corporate insurance affect your private insurance premiums in the future?
Unluckily, IF and that is IF your private policy insurer finds out, if they do a yearly check, their may be a surcharge applied. Please reminisce that if ever confronted with that question from your insurer, always be truthful or they could cut you. I am a Broker
If you have uninsured motorist insurance are in an accident and its you fault other driver has no insurance or drivers license can you get your car immobile if you only have liability insurance?
As a broker, I can tell you NO, there is no coverage if you are at fault. Now if you are only partially at fault, example, 50%, and it’s proven, there may be coverage under your carrier. I’m in Canada where things are a bit different but it wouldn’t hurt you to attempt right?
How can you get the insurance company to say your car is totaled when they claim they can fix it?
You can’t. Usually it is up to the insurance company’s discretion. They have the right to lodge their insurance claims for as little as possible without litigation.
Is the driver at fault insurance company responsible to fix your car at a figure shop of your choice using only OEM parts?
You will have to check your state law on this. If it is a no-fault state. Then your insurance will repair your vehicle and then bill the other driver’s company. I am not sure of the procedure in a “fault” state. You could attempt contacting your insurance agent or any auto insurance agent in your state.
Do you have to pay taxes on car accident settlement from the at fault insurance company?
I am a resident of Fresh York State and was involved in a individual injury accident. The settlement that I received is considered wages. You will have to check with your state and local tax laws. I am sure that a phone call to Jackson & Hewwitt or H & R Block in your state will work as well.
If you was in a car accident that was not your fault and you do not have insurance can you receive money from the other party’s insurance company?
Every once in a while you will hear of a proposed law “Pay to Play” which says that if you are driving illegally without insurance that you can’t expect to receive payments from an insured driver that runs into you. While I and many other people might like such a law, I have never heard of such a law that is in place at this time. So, if you are truly not at fault in the accident then I would imagine that you should be able to get payment from the at fault party.
Will your premium increase in the ratio of the amount insurance is paying to fix the car whether it is your fault or not?
Some insurance companies have “accident forgiveness” and others don’t. Even if an accident is not your fault, you are now viewed as a higher risk. You may be able to cancel the claim and fix the harm yourself, but you should do the math very first. Figure out the cost of repair versus the difference in your monthly bill for Three years. Take the road with the lower cost to you..
The question is does premium increases in the ratio of amount insurace carrier is paying to fix the car?
Do you have to tell your insurance policy that you were involved in an accident with a company car even however it was not your fault?
U should .
I heard that u should, and if your private insurance finds out that u were involed in a accident with a company car under company insurance ur insuance can be black list u..
i could be wrong.
If your attempting to get insurance for the very first time and you were involved in an accident with a company car under there insurance and it was not your fault do you still have to tell the insurance polic?
accident and Ins .
I had a minor at fault accident with a company vehicle. I provided my current car ins co with a letter from my old car ins co stating that they did not pay a claim on this accident. My fresh ins company accepted it and disregarded the accident..
You can do as above albeit it is best to tell insurance about all incidnets just in case other wise any undisclosed information could invalidate claims
Can you fight your insurance company in a your fault accident after they immobilized your car when it should have been totaled?
Absolutely! Regardless of fault, if you carry sufficient coverage (collision/comprehensive) you are entitled to have your vehicle either repaired to a “safe” standard, or a write-off payment received. The difficult part of proving such is in the time boundaries. DO NOT wait too long to seek a claim for a total loss. There is always the cargo of proof in this case, where you may have bruised your vehicle “after” the fact, and after such repairs were made. Note any visible harm, (eg. Doors not opening decently, engine problems) and have a certified bod shop/mechanic inspect the vehicle RIGHT after the initial repairs are made..
Generally an insurer will have an appraiser re-evaluate the damages to see if indeed, they were caused by the accident.
If someone hits your car and they’re at fault can their insurance company turn down to pay if you don’t have insurance?
in some cases this is true but you should get a lawers help incase you end up injured and not know it yet?? leagal help is always nice in these cases plus there help is advice is free there time cost…..
absolutely not, this has happend to me. if they attempt it get a lawyer asap. i did not risk it. got a lawyer and about 25 thousand dollars.
When a car with only liability insurance and a salvaged title is totaled a 2nd time what is the responsibility of the at faults insurance company as far as replacement?
The title is irrelevant, they need to put you in equal transportation during the claims process and issue you a check based on the cars book value. If they give you less then you feel is reasonable you do have the capability to negotiate. You better have logical well thought out facts tho. In other words, what will it cost to substitute your vehicle with an equal to your vehicle?
Can carriers raise your premiums for a serious accident where your car is totaled and the insurance company pays for your car but the insurance investigator ruled that the accident was not your fault?
yes if your ins.co. pays for your car..
They CanEven if they don’t pay for your car. My agent warned me that my homeowners premiums could be raised just for filing claims! They used to send an adjustor out automatically if there was a hailstorm or windstorm, but not any more. I just desired an ajustor to estimate the harm last spring and let me know if it would exceed my deductible.
Your car was written off by the at fault drivers insurance company what if the settlement figure is not enough for your finance company?
The amount suggested by the at-fault insurer should be the equivalent of the balance to finance company. Take NO LESS than that!!! This is called “indemnity” .
Use that word with the insurer… that will get them sitting up straight!.
Use that word and they may laugh at you. Insurance pays the VALUE OF THE VEHICLE. You can purchase Gap Insurance, usually through the financing company, which will cover the remainder of the loan.
When you are not at fault for an accident does the insurance company owe for collision insurance that I buy on the rental car?
“No” , not in most cases. I am assuming for the sake of answering your question that the facts are similar to this; you were in an accident you were not at fault the other company has accepted liablity for the loss, and put you in a rental while your vehicle is being repaired you only had liablity coverage on your vehicle (the one in the shop). But of course need collision and comprehensive on the rental you are now using. They do not owe to pay for this coverage for you (subject to any state laws to the contrary, you could call your states dept of ins. for that response, but I know of no states that require this). The presumption is, you didn’t think it was necessary to cover your own vehicle for coll and comp so why would they pay for it on the rental? I know your vehicle was older, this one is fresh, etc. I totally understand, but I have seenvery fewof these where the ‘at fault’ company will provide this coverage, you can of course buy/pay for a harm waiver for this rental with the rental car company, or contact your agent, and ask if there is anything they can do about a ‘brief term’ collision and comp coverage for this rental (but again I doubt this too)…..sorry, If I can be of any further assistance please let me know more details and I will do my best to help.
Do you have to call your insurance company if your car was not at fault?
The terms of your Insurance Contract always require that you report an accident regardless of fault. This is because even tho’ you do not consider yourself to be at fault, the other driver may report the accident to them anyway. Better to be safe than sorry.
What does an insurance company owe if you have a bruised car you can fix yourself?
An insurance company would owe you what it would cost to have a mechanic/figure shop repair the car. You have the option to keep the money or pay to get it repaired. If you are talking about your own insurance company then your deductible would come out of any amount paid if you have total coverage.
If you are drivng another persons car with permission and have no insurance but the car you are driving is insured will the car insurance pay to get the car motionless since you were at fault?
This is different from policy to policy. You need to check the holder’s policy to see what is covered. If the possessor didn’t pay for such coverage, then the harm is not covered..
Provided the holder is paying for comprehensive and collision coverage the harm will will be covered, subject to a deductible, as long as the driver is not excluded from coverage.
If you are in an accident and at fault will the insurance company repair your car?
It depends on what company you have insurance with, where you live, and how much coverage you have been paying for. I have The Hartford Insurance. I was in one, I was at fault and they paid for repairs on the other stud’s car and my car. It all depends on how much coverage you pay for in your premiums..
If you were in an accident with no insurance and it was not your fault but the other car at fault has insurance and was issused a ticket will there insurance company pay you or the bank?
The at-fault party’s insurance should cover your vehicle..
EVEN Tho’ OUR INSURANCE HAD RUN OUT BY AMONTH?
Do insurance company fix your car if you have halfway coverage?
what is half way coverage? If you mean liability only, then no, they only pay for the harm you cause to the other persons vehicle or property. if you mean 50/50 both drivers were at fault, then each company will pay half, after deductables.
If your car is a total loss will the insurance company help you fix it if you both pay?
If your car is deemed a total loss, the insurance company will only pay up the value of the vehicle. They will have nothing to do with the repairs. If the vehicle is worth $Five,000 and the harm is $8,000, you are going to pay $Trio,000 out of your own pocket. Once the insurance company pays you that $Five,000, they are out of the picture. Just be ready for a ‘salvage’ fee to be deducted from your settlement by the insurance company. That is what they would have gotten for your vehicle if you had surrendered it to them.
If a driver has no insurance but drives a car covered by no fault gets into an accident will the possessor of the car be able to file a claim with his insurance company?
No fault laws refer to injuries only not property harm. If you have comprehensive and collision coverage on your vehicle the harm to your car will be repaired subject to your deductible, unless the driver is excluded from your policy. For the driver’s injuries if he does not own a vehicle then the individual injury protection on your policy will cover his injuries, once again subject to any exclusions.
Car is at fault but they have no insurance?
I can tell you what happens in the State Of Alabama… Where we have a MANDATORY insurance law… To “protect” the law obiding, insurance carrying citizens from suffering a loss due to an uninsured motorist…..
Even however we have a LAW, it is a paper tiger..
I have dialed numbers until my fingers are blistered. I have talked on the phone until my ears are sore and my mouth hurts. In the end, I have been transferred, given wrong numbers and told to contact my congressman to “strengthen” our mandatory insurance law..
I did find out one thing however, we have a form called an SR-13 that can be downloaded from the Alabama Dept. Of Public Safety website. Even however this has nothing to do with the law or disturbance of it, it is tied to an old law that protects people from suffering a loss in the event of an accident with someone who has no insurance. Basically, their license will be suspended from anywhere inbetween Two and Ten years. Depending on the circumstance. If you are in Alabama, call the Dept. Of Public Safety and ask about this form or go to the website… http://www.dps.state.al.us/ and go after the quick links.. If you’re not, contact the same department in your state and embark there. Hope this helps.
Can a car insurance insist on paying the value of the car rather than fix the car if the accident is not your fault?
Yes, car insurance can pay the value of the car instead of fixing it. This will happen when the cost to fix it is greater than the current value. It is then not worth fixing, from a financial perspective. This is what is meant when you say that your car has been “totaled” (it was a total loss).
You live in Michigan you had an accident with a leased car with full-coverage insurance and it was their fault Will they pay for your car to get immobile?
There insurance will cover the cost of repairs to your vehicle. This works with any vehicle even if it is a rental.
If the insurance company totals your car do you have to accept it or do you have an option to have it immobile?
In most cases, you can get it immovable yourself. When the insurance company totals out a car, that is all they themselves are willing to pay. If you want to pay to have it immobile yourself, most won’t care, but your rates may still switch depending on the circumstances of the accident.
What is the responsibility of the insurance company of the at fault driver in a no fault state?
Instantaneously after an accident, you should call your insurance company and they will tell you their responsibility in that particular state. Your agent should have given you that information when you purchased your policy. Each state has slight differences. An insurance agent in this state is not licensed to comment on the insurance policies of another state.
Does the insurance company have to pay the entire bill to fix the car at the shop of your choice?
Provided your choice is something they agree with (they will normally give you the options they will permit) and that they are roped to pay for it, yes.
What if one insurance company mine not at fault said the car is a total loss but the other insurance company the at fault said they can fix it?
As far as i know the not at fault Insurance decision will prevail over the the one at fault. Besides there are certain “rules” that all insurance companies goes by when they take a determination whether or not a car is totaled. If by any chance the insurance companies can’t agree they go to an arbitrary service provided by state for insurance companies and they can come to a decision.
What if the insurance company won’t give you what it takes to fix the car?
You can sue them for the balance inbetween what has been suggested and the reasonable cost of repair. In that sort of a lawsuit, it is necessary that you retain an “experienced” witness, such as an experienced auto bod repair person to prepare an estimate of the cost of repair. Unless the case is lodged before trial, that person would have to brought to court to testify within the scope of his/her expertise. It is then the judge’s job to determine whether your accomplished or the insurance company’s (usually an adjuster) is more reasonable/correct in their assessment of damages. When a matter goes to trial, however, it is often useful to get a lawyer to assist, as there are rules of evidence that a layperson may not be familiar with. In turn, this may become complicated and costly than the amount in controversy justifies. All of that said, most states require that an insurer proclaim a vehicle to be a “total loss” when the cost of repair exceeds a stated percentage of its “actual cash value” (ACV). The ACV is harshly equivalent to the market value of a vehicle of like kind and quality, similar mileage, equipment, and other characteristics. If the vehicle is required to be totaled, the insurer will pay the ACV to the insured; if there is outstanding financing on the vehicle, it will pay the lienholder’s interest, with the balance going to the insured. The insurer will apply the policy collision deductible to whatever is paid. In come back for the payment of the ACV, the insurer generally gets to keep the remnants of the vehicle (salvage). It then sells the salvage for what it can get as a means of recouping part of its payment. The insured may have the option of keeping the salvage; in that event, its value reduces the payment made by the insurer to the insured.
How long after no fault car accident do you have to get settlement from other parties insurance company?
Varies by state to state. Usually its a 1 year period. Contact an injury attorney near you.
If you hit someone with no-fault insurance will your car be stationary?
The problem with no fault insurance is that fault is usually assigned thus making no fault insurance an incorrect statement. Your collision coverage is where you would make the claim in this situation.
Can you keep the settlement money from the at-fault driver’s insurance company and get your company to fix your vehicle?
No. You have the choice of either accepting payment from the other party’s insurer, or making a claim against your own collision coverage. If you own insurer pays your claim, it inherits your right of activity against the other party through a process called “subrogation”. Your auto policy most likely states that you would breach your duties under the insurance policy were you to hinder its subrogation rights.
When in a car accident that is not your fault dose the other Insurance company pay for the car rental Insurance?
Yes, as long as you had comprehensive and collision insurance on your own policy. Rental companies require you to have these and the other party will not pay for them.
If I don’t have collision insurance will insurance company fix my car?
It depends upon the type of harm and the cause of it; some physical harm is covered by the comprehensive coverage of an auto policy. For example, glass breakage and vandalism is normally covered by the comprehensive coverage. All of that said, collision and comprehensive coverages are generally suggested and purchased in tandem. Therefore, if one does not have collision coverage, there is a good chance that there is no comprehensive coverage.
Will the Insurance Company pay for a rental car if the accident is your fault and if you have utter coverage ins?
Only if you have bought the extra coverage to have a rental. “Total coverage” usually just means you bought liability, comprehensive, and collision insurance.

That’s your insurance companies problem, let them deal direct with them on your behalf (their job) and the two can determine which one pays. Just get some estimates and have the deductible ready.
What do you do if you get into a car accident and have no insurance and your at fault?
Plead and Pay. You will be responsible for all costs associated with the accident. If you don’t have the funds to pay the entire claim the more than likely the other party will file the claim on their uninsured motorist section of their auto policy. The UM will act as your insurance would have if you had insurance. They will then come after you for all amounts paid, plus interest, legal fees, and collection costs. In order to keep the legal and collection costs at a minimum you should attempt and work out a payment plan with the insurance company. Depending on the state you live in you will most likely face severe penalties, fines, and loss of your license. Some states will take your license until the amount owed is paid in total. You may be able to get a limited permit to go back and forward to work only.
When a person is at fault for harm to my car and their insurance co gives me the money to get car immovable do i have to use that money just for that purpose or is it mine to keep?
As long as you do not have a lien on your vehicle (still owe money on the car or truck) then you may do what you wish with the money. It is not required that you repair the vehicle and is your decision.
